Holyoke Man Pleads Not Guilty to Charge of Swearing Falsely
Hearing Set For March 1

Northampton, Feb. 1 — The case of Julius Erat, whose automobile collided with a dense at one of the Holyoke canals, giving ground for the inference that he had perished in the water after he had taken out insurance good for $87,000 in case of accident moved to the Northampton district court this morning. Erat, who paid a fine of $50 at Holyoke yesterday for damaging the fence, and paid $124 for restitution, was charged today with swearing falsely in making an application for insurance. he pleaded not guilty and the case was continued to march 1 for hearing. he furnished bonds of $5000. Foley of Easthampton appeared for him.

The complainant was Frank G. Hodskins of counsel for the Massachusetts Mutual Life Insurance company and the allegation was that the defendant on December 21, 1921, “did knowingly and willfully make a false and fraudulent statement and representation in and relative to a certain application for life insurance to the Massachusetts Mutual Life Insurance Company of Springfield. that is to say, in answer to the question in said application, “Have you ever applied wither directly or through an agent, to any company of association for insurance, without receiving a policy at that time of the exact kind and amount applied for?” Julius Erat falsely and fraudulently stated “No,” which said statement was then and there false as said Erat well knew.”
